TERMS & CONDITIONS

1. The Booking Contract

All purchases made through https://overatours.com, or via direct communication with authorized Overa Tours representatives (including email, WhatsApp, or telephone), are subject to the following Terms & Conditions.

In all bookings, the individual completing the reservation is considered to have accepted these conditions on behalf of all guests named in the travel party. No variation or amendment to these Terms & Conditions shall have legal effect unless confirmed explicitly in writing by an authorized director of Overa Tours (Private) Ltd.

2. Reservations & Confirmation Invoices

• Reservation Process: You may reserve a tour using our online inquiry system or directly with our private travel architects. Overa Tours (Private) Ltd. reserves the right to accept or decline any booking request at its discretion.
• Confirmation Email: Upon acceptance of your booking, a formal Confirmation Email will be issued containing the finalized day-by-day itinerary, hotel tier schedule, official invoice, and a copy of these Terms.
• Client Verification: It is the primary traveler’s responsibility to inspect all booking details (dates, passenger names, flight schedules, and inclusions) provided in the Confirmation Email prior to issuing invoice payment.

3. Payment Terms & Deposit Schedule

Your booking is officially confirmed upon receipt of the agreed deposit or full tour fee in accordance with your tailored invoice:

Once a booking is confirmed, it may not be cancelled other than in accordance with our cancellation and refund policy below.

4. Cancellation & Refund Policy

If you need to cancel your confirmed private tour, written notice must be received by Overa Tours from the primary contact email registered on the booking:

• More than 14 Days Prior to Tour Start Date: You will be liable for a cancellation administrative fee of no less than 25% of the total tour fee. Overa Tours will refund the remaining balance of any fees paid.
• Within 14 Days of Tour Start Date: Due to strict non-refundable boutique hotel allocations, vehicle prep, and permits, you will be liable to pay the tour fee in full (100%), and no refund will be issued.
• Start Date Cancellation or No-Show: If you cancel on the tour start date, leave an ongoing tour prematurely, or fail to arrive at Colombo International Airport (CMB), you will be liable for the full fee, and no refund will be granted.

5. Wildlife Safaris & Activity Disclaimers

Visits to Sri Lanka National Parks (including Yala, Wilpattu, Udawalawe, Minneriya, and Sinharaja Rainforest) involve outdoor exploration:

• Client Assumption of Risk: All wildlife national park game drives and outdoor activities are undertaken at the traveler’s own risk.
• Safari Vehicle Standards: 4x4 open-top safari jeeps deployed inside national parks are standard rugged utility vehicles operated by local park trackers. They feature basic statutory third-party insurance, which differs from the comprehensive passenger insurance carried by our touring fleet.
• Wildlife Sightings: While our expert trackers optimize timings, wildlife sightings (such as Sri Lankan leopards, sloth bears, or blue whales) are natural phenomena and cannot be guaranteed.

6. Mandatory Travel & Medical Insurance

Overa Tours (Private) Ltd. strongly advises all guests to obtain comprehensive international travel and medical insurance prior to departing their home country.

Insurance must cover trip cancellations, delays, personal medical emergencies, hospitalizations, loss of baggage, and events beyond reasonable control (such as inclement weather, flight cancellations, or natural occurrences). Guests agree that Overa Tours and its local hospitality partners bear no liability for expenses arising from such events. All claims must be lodged directly with your chosen insurance underwriter.

7. Passports, Identification & Entry Visas

• Passport Validity: All visitors to Sri Lanka must possess a passport valid for at least 6 months beyond their intended date of departure.
• Entry Visa (ETA): Guests are responsible for acquiring their Electronic Travel Authorization (ETA) via the official Sri Lankan immigration portal prior to arrival.
• Identification During Tours: All members of the travel party must carry valid photo identification during the journey, particularly when entering archaeological citadels and sacred temple shrines where student/senior reductions apply.

8. Amendments, Optional Day Tours & Add-ons

Overa Tours prides itself on flexible, bespoke journeys. Route alterations, hotel upgrades, or additional activities requested during your tour will be accommodated wherever logistically feasible.

Any supplementary services, extra vehicle mileage outside scheduled itineraries, or hotel upgrades requested by the client will incur additional charges, invoiced transparently at direct local rates.

9. Governing Law & Dispute Resolution

This agreement is governed by the laws of the Democratic Socialist Republic of Sri Lanka. In the rare event of a disagreement that cannot be resolved amicably, exclusive jurisdiction is conferred upon the courts of Sri Lanka.

Both parties agree that any controversy involving the interpretation or application of these conditions shall, upon written request, be submitted first to professional mediation, and if unresolved, to binding arbitration conducted in Colombo, Sri Lanka.
